For a Christian wife, the will is the only chance to have any share in the inheritance of her Muslim husband, because she does not have the right to inherit because of her religion. Then 1/8 of the inheritance is granted to the spouse, 2/3 to the son, 1/3 to the daughter, and 1/8 to the parents of the deceased. Another difference is that the process is attended by social workers and psychologists, necessary for the conciliation procedure, which is obligatory in this case. Eventually, the court rules the divorce. The burden of proof for the return of the gifts rests with the husband. It is worth paying attention to the fact that properties such as a flat or a car are easy to demonstrate, it is much more difficult with money and gold. The spouse has custody of the children and the right to receive maintenance. No marriage contract (intercourse) can take away a man's right to polygyny, as this would be against the Egyptian constitution, which grants him such a right. Nevertheless, a woman may reserve the right to divorce in an intercourse. The question of what the "mahr" and other financial arrangements should look like in such a situation must then be discussed by both parties with a lawyer. In Egypt, however, the exercise by a wife of the right to divorce, reserved in the intercourse, is still considered reprehensible, and rarely any woman chooses to do so. Instead, it relies only on the husband's declaration of allegiance. A Polish woman should not get confused, but refer to her status as a foreigner, i.e. staying in a foreign country without a family, and demand religious acceptance of such a clause. This clause does not deprive the spouse of his or her own right to divorce, as is sometimes misinterpreted. The husband also does not lose the right to re-adopt his wife during the idda period. However, this would only cause a delay, as the woman may seek a divorce again. A woman can therefore reserve the right to divorce in specific situations, e.g. if a spouse marries another woman (the second woman must be married with the consent of the first, otherwise it would be a violation of Egyptian law). For the same reason, just because a husband has married another woman does not mean that you are automatically divorced. The spouse is obliged to support the children and the wife who takes care of them. The amount of maintenance is calculated on the basis of the reported income and is currently 1/4 of the salary. It is doubtful that the court will recognize any other settlement included in the intercourse regulating this issue. In the event of divorce, as marriage is a security for a woman, the husband is obliged to pay his wife compensation, the so-called "motto" for the time she spent in marriage. If the spouse's financial situation allows it, the best security for a foreign woman, especially if the couple plans to have children, is the purchase of a condo in the wife's name. The reimbursement of the wife's return travel expenses may also be treated as "mahr". The freedom as to its form creates many possibilities that should be carefully considered and taken into account regardless of the circumstances. Spouse powers in Egypt In line with the previously discussed issues, there are also other related issues, such as the right to travel, exercise a profession and the right to visit. They should be included in the intercourse. However, as the current regulations governing them are beneficial to women, advice on the correct entry in the intercourse will be made by a lawyer.
